Machinery Regulation timeline
From entry into force in July 2023 to full application on 20 January 2027, with the dates in between (Art. 50 to 54)
Current Status: The Regulation entered into force on 19 July 2023 and applies in full from 20 January 2027 (Art. 54). Until then Directive 2006/42/EC remains the basis for placing machinery on the market; products placed under it before that date may continue to be made available (Art. 52).

Article 6(2) to (6), (8) and (11), Article 47 and Article 53(3) apply (Art. 54(d))

Specific report on the assessment of Article 6(4) and (5), then every five years (Art. 53(3))
Penalty rules notified; Article 50(1) applies
Member States notify the Commission of their penalty rules and measures (Art. 50(2), Art. 54(b))
The Regulation applies in full
Directive 2006/42/EC is repealed with effect from this date (Art. 51(2)); machinery placed on the market or put into service from now on must conform to the Regulation (Art. 54)
First evaluation report
The Commission reports on the evaluation and review of the Regulation, then every four years (Art. 53(1))

What to do in each phase, with the articles that require it
Design to the Regulation
New designs and running changes are best assessed against Annex III now
- Assess the risks per Annex III, including sections 1.1.9 and 1.2.1
- Decide the conformity route per product from Annex I and Article 25
- Build the Annex IV technical documentation while designing
- Plan digital instructions that meet Article 10(7)
Place under the Regulation
Everything placed on the market or put into service from this date follows the Regulation
- EU declaration of conformity per Annex V, kept updated (Art. 21)
- CE marking and, where applicable, the notified body number (Art. 24)
- Declaration and instructions online for the expected lifetime and at least 10 years (Art. 10(7) and (8))
- Identification and contact details on the product (Art. 10(5) and (6))
Keep conformity
Series production, complaints, corrective action and market surveillance
- Series production monitoring and sample testing where warranted (Art. 10(4))
- Complaints, non-conformity and recall register (Art. 10(4))
- Corrective action and notification of authorities where a product presents a risk (Art. 10(9))
- Cooperation with market surveillance (Art. 10(10), Chapter VI)

20 October 2026
Penalty rules notified
Member States notify the Commission of their rules on penalties and the measures to implement them (Art. 50(2)); Article 50(1) applies from this date (Art. 54(b)).
20 January 2027
The Regulation applies
Machinery, related products and partly completed machinery placed on the market or put into service from this date must conform to Regulation (EU) 2023/1230. Directive 2006/42/EC is repealed (Art. 51(2), Art. 54).
Products already on the market
Products placed on the market in conformity with Directive 2006/42/EC before 20 January 2027 may continue to be made available, and EC type-examination certificates and approval decisions remain valid until they expire (Art. 52).

How presumption of conformity works under the Regulation (Art. 20)
Two routes to presumption of conformity
Harmonised standards
Standards whose references are published in the Official Journal give presumption of conformity with the Annex III requirements they cover (Art. 20(1)); the Commission requests them from the European standardisation organisations (Art. 20(2))
Common specifications
Where harmonised standards are missing or insufficient, the Commission may adopt common specifications by implementing act; conformity with them gives the same presumption (Art. 20(3))
Cybersecurity certificates
A certificate or statement of conformity under a scheme adopted under Regulation (EU) 2019/881, once its references are published, gives presumption of conformity with Annex III sections 1.1.9 and 1.2.1 insofar as it covers them (Art. 20(9))
ISO/TR 22100-4
Guidance to machinery manufacturers on IT-security aspects, in relation to ISO 12100. Crosswalk maps it to the Regulation. It is guidance, not a harmonised standard.
IEC TS 63074
Security aspects related to functional safety of safety-related control systems. Crosswalk maps it to the Regulation. It is a technical specification, not a harmonised standard.
